LEGAL AFFAIRS DIVISION

Placed under the authority of a Head of Division, the Legal Affairs Division is responsible for:
– respect for the legality and legal regularity of acts;
– the preparation and formatting of draft legislative and regulatory texts initiated by the Ministry or submitted for the Minister’s signature;
– legal opinions on the problems falling within the competence of the Ministry;
– the promotion and popularization of legal culture within the Ministry;
– the defense of the interests of the State whenever the Ministry is involved in a case.
(2) It includes:
– the Studies and Regulations Unit;
– the Litigation Unit.
Placed under the authority of a Head of Unit, the Studies and Regulations Unit is responsible for:
– all studies relating to the conformity of the texts and acts taken by the Minister with respect to the legislation and regulations in force;
– the elaboration of texts or draft texts of a legal nature adopted by the Minister;
– the codification of legislative and regulatory texts.
(2) It includes, in addition to the Head of Unit, two (02) Assistant Research Officers.
Placed under the authority of a Head of Unit, the Litigation Unit is, subject to the powers devolved to the Ministry in charge of the Public Service, responsible for:
– the investigation of administrative and litigation appeals, in conjunction with the Technical Departments;
– defending the interests of the Ministry in court.
(2) It includes, in addition to the Head of Unit, two (02) Assistant Research Officers.
